Under the Massachusetts Lemon Laws, you may be eligible for compensation for your used vehicle if it has at least one qualifying defect that impairs its use or safety. The car must have been purchased from a Massachusetts dealer and be used for personal or family purposes (i.e. not used primarily for business). In Massachusetts, a dealer is defined as someone who sells more than 3 cars in a 12-month period, even if they do not have a valid used car dealer license.


You and the dealer must work together to clear the title of any encumbrances. You must transfer the title back to the dealer by contacting the Registry of Motor Vehicles and explaining that you are returning your vehicle under the Lemon Law and ask that a new title is issued to you as soon as possible.


While it is generally advised to never buy an As-Is used car from a used car lot, the unfortunate fact is that many people do not have the resources to do otherwise and are in need of a car immediately for transporting children and getting to and from work. And, while not all dealerships are predatory, enough are to make this a real problem for society.


Part of the problem lies in that most car buyers do not understand that "As-Is" is not necessarily all-encompassing protection for sellers. Unlike eBay where As-Is is typically used to remove any and all responsibility for items sold---of which many of us can relate to how difficult it is to file a complaint and seek recompense---the court system takes a special interest when it comes to questionable used car sales and tactics to take advantage of used car shoppers.

When car leases end, a lot of consumers simply choose to turn in the vehicle and lease another new vehicle from the same automaker. But the math has changed lately because of the pandemic and because a global shortage of microchips needed in new cars that has pushed up prices for vehicles new and used.


Fast-forward to the first few months of 2021, when consumer demand for both new and used cars came roaring back. Automakers were (and still are) hungry for microchips, needing dozens for every car, but suppliers were focused on other products and recovering from myriad challenges, including a fire at a major chip factory. The semiconductor industry is still working to adjust to the new demand, but it is taking time to get rolling. Pat Gelsinger, CEO of Intel, a major manufacturer of microchips, said in April that the semiconductor shortage could stretch into 2024.


Dealerships perform a used vehicle inspection and complete a window disclosure label before offering a vehicle for sale. They test drive the vehicle, and check the exterior of the vehicle, the underside, and under the hood for problems. They also review any paperwork they have for the vehicle, including the vehicle title. The dealership then completes a window label called the Wisconsin Buyers Guide. The Buyers Guide tells you if the vehicle has any existing problems or important history you should know about. Dealerships are required to list any problems they should reasonably have known about based on their inspection, test drive and paperwork check. They do not have to take vehicles apart or run diagnostic tests to find hidden problems. They also do not have to tell you about future problems your vehicle may develop because of its current age or condition.


Title brands are permanent notations that will appear on any future title issued for a particular vehicle. Brands show, for example, whether a vehicle was rebuilt salvage, flood damaged, or bought back by the manufacturer under a lemon law.
